General Terms and Conditions

  1. General

These general terms and conditions apply to all orders and purchases via the Chocolatte webshop (www.choco-latte.nl). By placing an order, you agree to these terms and conditions. Chocolatte reserves the right to change these terms and conditions. The version in force at the time of ordering applies. 

  1. Products and Availability

Chocolatte offers a range of sweet treats, including cannoli, nougat, aragostine, bonbons, chocolate bars, truffles and hot chocolate spoons. All products are prepared and packaged with care. We strive to keep our stock status accurate and communicate this in the webshop. If a product is unexpectedly not immediately available, we will contact you to offer an alternative.

  1. Ordering and Payment

Online orders can only be placed via the webshop. This also applies to orders that are collected in the store. Payment can be made via iDEAL, credit card, Apple Pay, PayPal and other offered payment methods. An order is final once payment has been received and confirmed by Chocolatte.

  1. Delivery

Delivery is possible in the Netherlands, Belgium and Germany. Orders will be delivered within maximum 3 working days, unless stated otherwise. Optionally, the order can be collected in the store in the Markthal in Rotterdam. Chocolatte is not responsible for delays caused by delivery services (transporters) or because of a so-called Act of God. Chocolatte is not responsible for late delivery if the shipment cannot be delivered to the specified address and time. We do not ship to PO Box numbers.

  1. Shipping costs

The shipping costs are stated during the ordering process. For orders above a certain amount, free shipping may apply. This is indicated in the webshop.

  1. Retention of title

Ownership of a product ordered in this webshop only passes to the Buyer after payment has been made in full. The Buyer may not encumber, sell or deliver the product (or products) after ownership of the product has been transferred.

  1. Right of Withdrawal and Return Policy

Due to the nature of the products (perishable goods), withdrawal is not possible. In the event of damage to the shipment or an incorrectly delivered product, Chocolatte must be contacted within 24 hours of receipt of the shipment by sending an email to klantenservice@choco-latte.nl. In the event of a damaged shipment, we would like to receive several photos that clearly show the condition in which the product was received. Chocolatte will offer an appropriate solution, such as a replacement product or refund. If the buyer returns a damaged or incorrect delivery to Chocolatte without express prior permission, this is at their own expense and risk.

  1. Complaints and Liability

Chocolatte strives for the highest quality and customer satisfaction. Complaints can be submitted within 7 days of delivery via klantenservice@choco-latte.nl. Chocolatte is not liable for damage resulting from incorrect use or storage conditions of the products. Store our products in a cool, dry place.

  1. Privacy and Data Protection

Chocolatte processes personal data in accordance with the GDPR (General Data Protection Regulation). Personal data is only used for order processing and communication with the customer. Chocolatte does not share customer data with third parties without permission, unless legally required. Read our Privacy Statement

  1. Applicable Law and Disputes

All agreements between Chocolatte and the customer are subject to Dutch law. Disputes are preferably resolved by mutual agreement. If this is not possible, the dispute will be submitted to the competent court in the Netherlands.
